Wine Club Agreement

Please read the following carefully. 

Keel and Curley Winery (Keel and Curley) will ship your club wine selections directly to your home or office. We simply charge the credit card provided on your application at the time of shipping. Please note that it is your obligation to notify Keel and Curley of any account changes 15 days before the beginning of a shipment month. Membership is ongoing and may be cancelled with a 15-day notice after receiving your second club shipment. Keel and Curley requests a two-shipment minimum commitment to the wine club. 

Due to legal restrictions, we are only permitted to ship wine to select states. Please note that verification of age and signature is required at the time of delivery. Carriers make two attempts to deliver, after which the wine is returned to Keel and Curley. No wine will be delivered to a visibly intoxicated person, and any person unable to produce age verification forfeits the right to receive the shipment until identification is produced. In such circumstances, the order may be held in storage at a local depot until appropriate identification is produced, or it may be shipped back to the winery. If a wine shipment is shipped back to the winery, the customer is responsible for freight charges. 

Typically, orders are sent out on the 20th of each month. Orders placed after the 20th will be shipped right away if that month is selected. In the event of very cold temperatures that could affect the wines, we may delay shipment. If this should occur, we will let you know. 

Member discounts and benefits are not valid with other special offers or discounts offered by our stores. Member benefits are non-transferable. All goods, services and benefits provided by Keel and Curley, including wines, are only provided and/or shipped to such states in which Keel and Curley is licensed to provide such goods, services and benefits. Keel and Curley is not engaged in the shipping or importing of wines or other products into or from any state, country or other jurisdiction where it is not so licensed. Membership in the Wine Club is void where prohibited, and by joining the Wine Club, you represent that your membership in the Wine Club and receipt and use of any goods, services or other items received through the Wine Club does not and will not violate any applicable law or regulation. You agree to comply with all applicable laws, rules and regulations, including without limitation, laws governing the possession and use of wine and alcoholic beverages. If any product is requested to be provided in or shipped to any state where Keel and Curley is not appropriately licensed, Keel and Curley can refuse such shipment. Wines will be provided or delivered only to persons who are at least 21 years old. In joining the Wine Club, you represent to Keel and Curley that you are at least 21 years old and the person to whom delivery of any wine will be made. When your wine is picked up or delivered, the person receiving the product will be required to show identification proving Wine Club membership and that he or she is at least 21 years old.  Wines provided or delivered by the Wine Club are not for resale and are for personal consumption only. Keel and Curley has the right to terminate or suspend the Wine Club, or your membership in the Wine Club, at any time and for any reason whatsoever, including, without limitation, following a change in law. 

If you have selected the option of shipment of your wine to you, the wine will be sent quarterly, and there is no available return or exchange for shipped wines except as set forth in this paragraph.  Wine is a delicate and perishable commodity, and if your wine is being shipped, conditions outside of the control of Keel and Curley may adversely affect the wine during shipment. If your wine, at the time of delivery, is received damaged, spoiled or otherwise defective, you may contact us regarding the damage and Keel and Curley may, in its discretion and based on the particular conditions of each such circumstance, send a replacement in exchange, which is your sole and exclusive remedy for damaged or defective product. Keel and Curley will not refund shipping charges, and additional shipping and other charges will apply to deliveries to you that are returned as undeliverable or refused. 

In the event of any circumstances outside of the control of Keel and Curley and which prevent, hinder or delay Keel and Curley from performing its obligations, including but not limited to acts of God, earthquake, flood, severe weather conditions, or other natural calamity, strikes, insurrection or acts of terror, governmental action or inaction, including delays or failure to issue permits and authorizations or an inability to obtain supply and materials or means of shipping, Keel and Curley obligations will be suspended for the term of such event or Keel and Curley may elect to cancel the Wine Club or Wine Club membership for the affected members. 

Limited bottling wines are on a first-come first-serve basis. Members who request pick-up as the option for their order have 90 days from processing to retrieve their club wines from the specified pick-up location. After the pick-up grace period has ended, substitutions may result for your preferred bottle selection or a $25 restocking fee. 

Members should notify the tasting room staff in advance when friends or family are picking up for them. 

 

Refunds and Cancelations

Please Note:

You must be 21 years old to order or receive wine from Keel & Curley. All wine orders are sent with Adult Signature Required, and the carriers that deliver our wines are required to check for identification upon delivery. Failure to produce age verification forfeits the right to receive the order. If this happens, the order may be held with the local shipping company until identification is provided, or it may be shipped back to the winery. All associated costs will be the responsibility of the customer, including a $20 restocking fee should the wine be returned to the winery.
